Terms & Conditions of the Herbablast Online Store

§ 1. General Provisions
- The online store operating at herbablast.eu (the "Store") is run by Konrad Siej, operating a sole proprietorship under the business name Konrad Siej, registered with the Polish Central Registration and Information on Business (CEIDG), Tax ID (NIP): 7141984367, REGON: 523848745, registered address: ul. Władysława Łokietka 2, 21-100 Lubartów, Poland (the "Seller").
- The Seller can be contacted via email at: hello@herbablast.eu.
- These Terms & Conditions set out the rules for using the Store, placing orders, entering into distance sales contracts, payment, delivery, and complaints and withdrawal from the contract.
- These Terms & Conditions apply to all Customers of the Store, with the provisions concerning consumers applying to individuals making a purchase not directly related to their business or professional activity (Article 22¹ of the Polish Civil Code), as well as — to the extent provided by the Polish Consumer Rights Act — to individuals entering into a contract directly related to their business activity where the content of that contract indicates it is not of a professional nature for them.
- The Store sells exclusively within the territory of the Republic of Poland. Orders for delivery outside Poland are not currently fulfilled.
§ 2. Sales Model — Information on Order Fulfillment
- The Seller informs Customers that products offered in the Store are not stocked by the Seller. Once an order is placed and paid for, the Seller forwards it for fulfillment to a third party — the manufacturer and supplier of the product (the "Supplier") — who packs the goods and ships them directly to the Customer.
- The Seller is the sole party to the sales contract concluded with the Customer. The Seller bears responsibility to the Customer for order fulfillment, conformity of the goods with the contract, and handling of complaints, regardless of the fact that physical shipping is carried out by the Supplier.
- Personal data necessary to fulfill the shipment (first and last name, delivery address, phone number) is shared with the Supplier solely for the purpose and to the extent necessary to fulfill the order. Details on the processing of personal data can be found in the Privacy Policy.
§ 3. Products and Food Information
- The Store sells food products within the meaning of applicable food law. The current range of the Store is presented on the /sklep page and may be expanded to include further food products.
- a full list of ingredients, including substances or products causing allergies or intolerance reactions (allergens) — in accordance with Regulation (EU) No. 1169/2011,
- storage conditions appropriate for the given product,
- the best-before / use-by date,
- the weight or quantity of the product,
- the packaging method.
- Some products may be packaged in a special way (e.g. vacuum-sealed) to extend their shelf life. Regardless of the packaging method used, every food product offered in the Store remains a foodstuff requiring the storage conditions indicated on the packaging and on the product page.
- If in doubt about the ingredients, allergens, or storage method of a specific product, the Customer may contact the Seller at hello@herbablast.eu before placing an order.
- The information referred to in item 2, including in particular the list of allergens and the full ingredient list, is verified by the Seller directly with the manufacturer of the given product before it is introduced into the Store's offering and is published on that product's page. In the event of any doubt as to the accuracy or completeness of this information, the ingredients and allergen list shown on the label of the delivered product shall prevail.
§ 4. Placing Orders
- Orders are placed via the order form available on the Store's website.
- Placing an order requires providing accurate information: first and last name, delivery address, email address, and phone number.
- After placing an order, the Customer receives a confirmation at the email address provided. The sales contract is deemed concluded once the Customer receives confirmation that the order has been accepted for fulfillment.
- Product prices shown in the Store are gross prices (including VAT) and are expressed in Polish złoty.

§ 5. Delivery
- Orders are delivered by courier within the territory of Poland within 2–3 business days from the moment the order is handed over to the Supplier for fulfillment.
- The delivery cost is shown to the Customer before placing the order, in the cart summary.
- Due to the nature of the product (food requiring refrigerated storage), the Customer is obliged to collect the shipment as soon as possible after delivery and to promptly place the product in the refrigerator.
§ 6. Right of Withdrawal
- In accordance with the Polish Consumer Rights Act of May 30, 2014, a Customer who is a consumer has the right to withdraw from a distance contract within 14 days without giving any reason.
- The withdrawal period begins on the day the Customer (or a third party other than the carrier indicated by the Customer) takes possession of the goods.
- Exception for food products in sealed packaging. In accordance with Article 38(5) of the Polish Consumer Rights Act, the right of withdrawal does not apply to goods delivered in sealed packaging which, once opened, cannot be returned for health or hygiene reasons, if the packaging has been opened after delivery. This applies to food products offered in the Store regardless of the packaging method used (vacuum-sealed or other sealed packaging indicated on the given product's page). In view of the above:
- if the product's sealed packaging remains intact (closed), the Customer is entitled to withdraw from the contract under the general rules (14 days),
- if the product's sealed packaging has been opened after delivery, the right of withdrawal does not apply — because a food product delivered in sealed packaging cannot, once opened, be reintroduced into circulation for sanitary and hygiene reasons.
- To exercise the right of withdrawal, the Customer should inform the Seller of their decision by way of an unambiguous statement (e.g. a letter sent by post or email to hello@herbablast.eu) before the deadline referred to in item 1 expires.
- In the event of withdrawal from the contract, the Seller shall reimburse the Customer all payments received, including the cost of delivering the goods (except for additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller), without undue delay and in any case no later than 14 days from the day the Seller was informed of the decision to exercise the right of withdrawal.
- The Seller may withhold reimbursement until the goods have been received back or until proof of their return shipment has been provided, whichever occurs first.
- The Customer bears the direct cost of returning the goods.
§ 7. Complaints
- The Seller is obliged to deliver goods to the Customer that conform to the contract. In the event of a defect in the goods, the Customer is entitled to warranty rights under the terms set out in the Polish Civil Code and the Polish Consumer Rights Act (in particular the provisions on non-conformity of goods with the contract).
- A complaint can be filed by sending an email to hello@herbablast.eu, describing the non-conformity of the goods with the contract and, if possible, attaching a photo of the product.
- The Seller will respond to the complaint within 14 days of receiving it.
- Due to the nature of the product (food), the Seller recommends reporting any non-conformities (e.g. damaged packaging, signs of a broken vacuum seal, incorrect shipment temperature) as promptly as possible after receiving the shipment.
§ 8. Personal Data
The rules for processing Customers' personal data are described in a separate document: the Privacy Policy.
§ 9. Final Provisions
- In matters not regulated by these Terms & Conditions, the provisions of Polish law shall apply, in particular the Polish Civil Code and the Polish Consumer Rights Act.
- The consumer has the option of using out-of-court methods of handling complaints and pursuing claims, including contacting the competent provincial inspector of the Trade Inspection or using the ODR online platform available at: https://ec.europa.eu/consumers/odr/.
- The Seller reserves the right to amend these Terms & Conditions for important reasons (e.g. changes in law, changes to the payment or delivery method). Orders placed before the changes take effect will be fulfilled under the previous terms.
