Herbablast User Account Terms

§ 1. General Provisions

  1. These Terms govern the creation and use of a User Account in the online store operating at herbablast.eu (hereinafter: the "Store"), including the use of features available only after logging in — the list of favorite products and the ability to leave product reviews and ratings.
  2. The Service Provider is Konrad Siej, operating a sole proprietorship, NIP: 7141984367, REGON: 523848745, with its registered office at ul. Władysława Łokietka 2, 21-100 Lubartów, Poland (hereinafter: the "Service Provider").
  3. The Service Provider can be contacted via the email address: hello@herbablast.eu.
  4. Maintaining a User Account and using its functionality constitutes a service provided electronically within the meaning of the Act of 18 July 2002 on the Provision of Electronic Services, and is separate from the contract of sale entered into in connection with placing an order in the Store. The rules governing purchases, payment, delivery, and the right of withdrawal from the contract of sale are set out in a separate document — the Store Terms & Conditions.
  5. Creating an account is voluntary and free of charge. The Store allows purchases both by Users with an account and without creating one (guest checkout).

§ 2. Creating and Using an Account

  1. Creating an account requires completing the registration form (providing a username, email address, and setting a password), confirming the email address via an activation link, and accepting these Terms.
  2. The agreement for the provision of the account service is concluded at the moment the User confirms registration (activates the account).
  3. The User is required to provide truthful information and keep the account password confidential. The User is responsible for actions taken using their account, unless these resulted from actions of the Service Provider or third parties for whom the Service Provider is responsible.
  4. The User may cancel their account at any time by sending such a request to hello@herbablast.eu or by using the account deletion feature available in the User's panel.
  5. Deleting an account is equivalent to terminating the agreement for the provision of the account service and results in the deletion of data associated with the account (favorites, reviews, history), except for data the Service Provider is required to retain under separate legal provisions (e.g. tax law, if the account was associated with placed orders).

§ 3. Features Available After Logging In

  1. Registered Users have access to the following features:
    • list of favorite products,
    • leaving star ratings and written reviews of products (rules in § 4),
    • history of placed orders.
  2. The Service Provider reserves the right to develop, modify, or withdraw individual account features, and will inform Users with reasonable advance notice in the case of significant changes.

§ 4. Rules for Posting Product Reviews and Ratings

  1. The ability to leave product reviews and (star) ratings is available exclusively to registered and logged-in Users.
  2. The Service Provider informs that the ability to leave a product review is available to every registered User, regardless of whether they have actually purchased the given product in the Store. The Service Provider does not verify whether the author of a review has actually purchased or used the reviewed product.
  3. By posting a review or rating, the User agrees to comply with the following rules:
    • the review must not contain profanity, offensive, degrading, or discriminatory content, or otherwise violate good practice or the personal rights of others;
    • the review must not contain promotional or advertising content unrelated to the reviewed product, including in particular references to other online stores, brands, or products competing with the Store's offering;
    • the review should relate directly to the reviewed product and the User's experience with purchasing or using it.
  4. By posting a review, the User grants the Service Provider a non-exclusive, royalty-free licence to publish, display, and moderate it within the Store, for the duration of the agreement for the provision of the account service and for the period necessary to demonstrate the grounds for any prior moderation.
  5. The Service Provider reserves the right to moderate reviews that violate the rules set out in item 3, including editing them to the extent necessary to remove violating elements (e.g. profanity), or removing the review entirely. Moderation is carried out objectively, proportionately, and without arbitrariness.
  6. In the event a review is removed or its visibility restricted, the Service Provider will inform the User of this decision electronically (email or in-account notification), indicating the content the decision concerned and the reason for the action taken.
  7. The User has the right to object to a moderation decision regarding their review within 14 days of receiving it, by sending an email to hello@herbablast.eu describing the reasons why, in their view, the moderation decision was unjustified. The Service Provider will review the objection and inform the User of the outcome within 14 days of receipt.

§ 5. Liability and Complaints Regarding the Account Service

  1. The Service Provider makes every effort to ensure the User Account operates without interruption, while reserving the possibility of temporary technical interruptions related to the Store's maintenance or updates.
  2. Complaints regarding the account's functioning (e.g. technical errors, login problems) may be submitted to hello@herbablast.eu. The Service Provider will respond to complaints within 14 days of receipt.

§ 6. Termination of the Account Service Agreement

  1. The User may terminate the agreement for the provision of the account service at any time and without giving a reason, in accordance with § 2 item 4.
  2. The Service Provider may terminate the agreement for the provision of the account service with immediate effect in the event of a serious or persistent breach by the User of these Terms, in particular the rules set out in § 4 item 3, following a prior, unsuccessful request that the User cease the violation, unless the nature of the violation justifies immediate termination without prior notice.

§ 7. Personal Data

The rules for processing Users' personal data are described in the Privacy Policy.

§ 8. Final Provisions

  1. In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Civil Code and the Act on the Provision of Electronic Services.
  2. The Service Provider reserves the right to amend these Terms for important reasons (e.g. changes in law, development of the Store's functionality). Users with an account will be informed of changes to the Terms electronically, with reasonable advance notice, before they take effect.
